A Thousand Oaks couple want to keep retaining walls and decks that were built without permits within a restricted use area of their property.

The planning commission has twice said no. Now an appeal to the planning commission's last decision is set to be discussed at the 6 p.m. Tues., July 14 City Council meeting.

Applicants John and Chanida Walsh own 1.44 acres at 5433 N. Lakeview Canyon Road. They built a house on the unrestricted area of .62 acres, but they would like to develop an area of the remaining land, which is restricted.

In December 2007 the planning commission denied decks, retaining walls more than 6 feet high, and grading in a natural slope of more than 25 percent along with the encroachment of eight oak trees, planner Joey Lin said.

The Walshes came back this year on April 27 with a design reduced in size that encroached on one oak tree. That application was also denied. The couple is appealing that decision.
