If your car is stopped and you accelerate and hit something directly in front of you, then you are absolutely at fault. He stopped. His bike and direction of travel were irrelevant. As a pedestrian at a crosswalk, I have had to knock on hoods of cars whose drivers attempt a right-on-red without ever looking right (and often without stopping). If you don't have time to look both ways before pulling into a gap in traffic, then the gap is too small. Wait for a larger one and look both ways. It is your responsibility, no two ways about it.
