Land-use decisions aren't always fair and equitable The city of Thousand Oaks has run into another of those perplexing land-use problems (see story on page 13). In one form or another, they almost always boil down to the rights of a property owner versus the government, which, in turn, represents the people. In America, landowners have rights to develop their property as long as they respect zoning and other laws. They can't build just anything they want, and they can't bulldoze trees or mountains. Government also has rights, including that of eminent domain. The best interests of the people are placed in the hands of elected officials. Officeholders are expected to do what's necessary for the public good- without abusing their power. The latest dilemma involved Armstrong Garden Center, a longtime business that's being forced to relocate. The preferred site would have worked, but only if Thousand Oaks had reduced the city's parking requirements for garden centers. Unofficially, however, the same parcel had been penciled in- somewhat ironically- as a future parking facility for existing and future retailers and/or restaurants. The specific plan hasn't been finalized, but planners and elected officials always need to think ahead- sometimes many years ahead. On one hand was a garden center, a business that sells products to virtually every homeowner. On the other hand were city officials representing the best interests of the taxpayers, both today and in the future. For now, the city has delayed the garden center. By not allowing a speedier process to the request to reduce parking requirements, the city prevented the garden center from moving forward with its plan. As always, the trick with land-use decisions is to find an equitable outcome for all parties. It's easier said than done. Barring a last minute miracle, it's back to the drawing board for the garden center. It's a sad fact of life, but fair and equitable solutions can't always be found. |
